1. Acceptance of Terms

By placing a pre-order with Apsley Farms ("we", "us", "our"), you ("customer", "you") agree to be bound by these Terms and Conditions. These terms apply to all pre-orders, deliveries, and services provided by Apsley Farms.

2. Product Safety and Handling

2.1 Dry Ice Safety Requirements

Dry ice is solid carbon dioxide at -78.5°C (-109.3°F) and requires careful handling. By pre-ordering dry ice, you acknowledge that:

• You understand the safety risks associated with dry ice handling
• You have adequate ventilation in storage and use areas
• You will use appropriate personal protective equipment (PPE)
• You will not store dry ice in airtight containers
• You will keep dry ice away from children and untrained personnel

2.2 Customer Responsibility

The customer is solely responsible for:

• Safe handling, storage, and use of dry ice products
• Ensuring all personnel are properly trained
• Compliance with local health and safety regulations
• Providing adequate receiving facilities for delivery

3. Pre-orders and Acceptance

3.1 Pre-order Placement

Pre-orders may be placed via our website, phone, or email. All pre-orders are subject to acceptance by Apsley Farms. We reserve the right to refuse or cancel any pre-order at our discretion.

3.2 Product Availability

While our biogas operation enables 365-day production, product availability may be affected by:

• Maintenance requirements
• Equipment failure
• Extreme weather conditions
• Raw material supply issues

3.3 Pre-order Cancellation

Pre-orders may be cancelled up to 24 hours before scheduled delivery. Emergency pre-orders may not be cancellable once production has commenced.

4. Pricing and Payment

4.1 Pricing

All prices are quoted in British Pounds (GBP) and are subject to change without notice. Prices include delivery within our standard delivery area.

4.2 Payment Terms

Payment is due on delivery unless alternative arrangements have been agreed in writing. We accept:

• Cash on delivery
• Bank transfer (for established accounts)
• Company purchase orders (subject to credit approval)

5. Delivery Terms

5.1 Delivery Scheduling

We will make reasonable efforts to deliver within the requested timeframe. Delivery times are estimates and not guaranteed unless specifically agreed in writing.

5.2 Delivery Conditions

Successful delivery requires:

• Safe and accessible delivery location
• Authorized personnel present to receive the pre-order
• Appropriate handling equipment available
• Clear access route for delivery vehicle

5.3 Failed Deliveries

If delivery cannot be completed due to customer-related issues, redelivery charges may apply. The customer remains liable for payment of the original pre-order.

6. Product Quality and Sublimation

6.1 Quality Standards

Our dry ice meets food-grade standards and is produced from renewable CO₂. We guarantee the quality of our products at the point of delivery.

6.2 Natural Sublimation

Dry ice naturally sublimates (converts from solid to gas) at approximately 5-10% per day under normal conditions. This is a natural property of dry ice and not a product defect.

7. Limitation of Liability

7.1 Liability Limits

Our liability is limited to the value of the products supplied. We shall not be liable for:

• Injuries resulting from improper handling
• Property damage due to misuse
• Indirect, consequential, or punitive damages
• Loss of profits or business interruption
• Natural sublimation of dry ice

7.2 Force Majeure

We shall not be liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or equipment failures.

8. Insurance and Indemnification

The customer agrees to maintain adequate insurance coverage and indemnify Apsley Farms against any claims arising from the use, storage, or handling of our products.

9. Environmental Responsibility

Our dry ice is produced from renewable CO₂ captured from our biogas operations, contributing to environmental sustainability. Customers are encouraged to use dry ice in environmentally responsible applications.

10. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws. Customer information is used solely for pre-order fulfillment and service improvement.

11. Dispute Resolution

Any disputes shall be resolved through English courts under English law. We encourage customers to contact us directly to resolve any concerns before pursuing legal action.

12. Amendment of Terms

These terms may be updated periodically. Continued use of our services constitutes acceptance of any revised terms. Major changes will be communicated to existing customers.
